The Health Insurance Portability and Accountability Act (HIPAA) of 1996 is the most complex piece of Federal health care related legislation passed by Congress in the last 50 years; the Act has revolutionized the way health care is provided in the United States The Privacy Rule portion of the Act sets a strict Federal standards for the privacy of all personal health information (PHI) stored in whatever form i.e., machine readable, on paper, oral, etc. The Privacy Rule has proven the most complex for health care providers to understand since, unlike the Security Rule, there are fewer, well established templates for compliance available. Most organizations know something about information security but few, prior to HIPAA had full blown privacy policies. Fraud Examiners and Auditors will be confronting the provisions of this Act whenever they or their clients deal with issues of customer or patient privacy, both inside and outside of government for years to come. Any Auditor or Fraud Examiner with knowledge of the HIPAA Privacy and Security Rules will be at a definite advantage in securing and servicing future clients within the health care and all other industries.
